Volunteer Driver Agreement & Waiver of Liability Waiver of Liability(Required) I agree to the following agreement:I, for and on behalf of myself and my children, heirs, executors, administrators, and representative, agree to release, indemnify and defend NOCO Humane its officers, employees, and representatives with respect to all claims, liabilities, losses, suits, or expenses (including costs and reasonable attorneys fees) made or brought by anyone, arising out of any injury, damage, death, or other loss in any way connected with my participation as a volunteer driver for NOCO Humane. This agreement includes any losses claimed to be caused, in whole or in part, by the negligence of NOCO Humane. I understand I agree here to waive all claims against NOCO Humane and agree that neither I nor anyone acting on my behalf, will make a claim or file a lawsuit of any kind against NOCO Humane, as a result of any injury, damage, death, or other loss suffered by me. I state that I am an adult over the age of 21 with a valid driver’s license and that I have at least the minimum amount of liability insurance specified by the State of Colorado. I will notify NOCO Humane in writing if there is a change in the status of my driver’s license or vehicle liability insurance. I understand that any cause of action arising out of my voluntary participation is my sole responsibility, and agree to solely pursue my vehicle liability insurance for any causes of action for personal injury, property damage, or death arising from my actions and not to sue NOCO Humane. Shall I be driving an organizational-owned fleet vehicle; I allow NOCO Humane to release my information to Larimer Humane Society’s auto insurance company. Annual Motor Vehicle Record reports may be run by the insurance company. I agree that this and all aspects of my relationship to NOCO Humane are governed by Colorado State law. Further, any mediation, suit, or other proceeding arising out of or relating to my participation in NOCO Humane activities, must be filed exclusively in the State of Colorado, and Colorado State law shall apply. I also agree that if I assert a claim or file a suit against Larimer Humane Society, I will pay all costs and attorney’s fees incurred by NOCO Humane in defending that claim or suit, if the claim is withdrawn or dismissed, or to the extent a court determines that NOCO Humane is not responsible for the injury or loss. Any portion of this document deemed unlawful or unenforceable shall not affect the remaining portions of the Document, and those remaining provisions shall continue in full force and effect. I understand that driving as a volunteer is a privilege, not a right, and therefore, I agree to: · Provide evidence of my current status as a licensed driver in Colorado · Provide evidence of my liability insurance on a yearly basis as requested · Comply with all of NOCO Humane’s policies and procedures and any directions provided by my supervisor · Comply with all laws and regulations concerning driving, including laws pertaining to the use of seat belts, child safety seats, cell phone use, and speed limits · Promptly notify my supervisor of any physical conditions, vehicle defects, or road conditions that might affect my safety or the safety of those I am driving · Notify my supervisor of any traffic citations I receive—even if given while driving on my personal time · Watch driver training videos at the request of NOCO Humane · And, if involved in an accident, I agree to complete an Accident Report provided by NOCO Humane and to cooperate with the police, my supervisor, and NOCO Humane’s insurer, its insurance adjusters, and attorneys. I pledge that if I drive my own vehicle, or shelter vehicle on behalf of NOCO Humane, I will maintain adequate personal auto insurance and a valid driver’s license.
